Please also read our Privacy Policy. Jolaby Ltd (Atom Label) may change these terms from time to time without notice to you. Changes will apply to any subsequent orders received.

PAYMENT SECURITY

At Jolaby Ltd (Atom Label) we use the latest Payment & Security software allowing our customers to experience a happy shopping experience. We accept all major cards which are processed by Shopify. 

Product Display

Jolaby Ltd (Atom Label) has made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery.
 
All sizes and measurements are approximate, however we do make every effort to ensure they are as accurate as possible. Unless otherwise stated, sizes indicated are UK sizes. Please refer to the size guide for clarification conversion for further information.
 
We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. We reserve the right to refuse orders where product information has been mis-published, including prices and promotions.
 
Prices are subject to change without notice. Prices are inclusive of VAT (where applicable).

Goods are subject to availability. As there is a delay between the time when the order is placed and the time when the order is accepted, the stock position relating to particular items may change. If an item you have ordered becomes out of stock before we accept the order we shall notify you as soon as possible and you will not be charged for the out of stock items.
 
We continually update our online store. From time to time our retail stores may run special local promotions (which may not be available on our web-site) or we may offer special discounts online that are not available in the retail stores or via our stockists. Some website promotions may not be available to customers in particular jurisdictions.
 
All company trade marks, brand, product names and logos mentioned on this website are used for identification purposes only and are registered trade marks of their respective owners who reserve all the rights of ownership. The use of, or mention of any brand name, trade mark, or product name on this website is no way intended to suggest that the company, brand or trade mark owner is in any way affiliated with or endorses this website.  
 
All images on the website are copyright of Jolaby Ltd (Atom Label) and can not be re-produced or used without Jolaby Ltd (Atom label) permission. All models and their images are not to be used on any website without prior permission in writing from Jolaby Ltd (Atom Label). If they are used they will be financial costs incurred for sales generated using the images.

Purchase of Products

When you place an order on our website we shall email you an acknowledgement. Our acceptance of an order does not take place until dispatch of the order, at which point the purchase contract will be made and you will be charged.
 
Once you have checked out and your order has been confirmed you will not be able to make any changes to your order so please make sure that everything is correct before completing your order.
 
We reserve the right to refuse an order. Non-acceptance of an order may, for example, result from one of the following:

1. The product ordered being unavailable from stock

2. Our inability to obtain authorisation of payment

3. The identification of an error within the product information, including price or promotion

4. If there are any problems with your order we shall contact you. We reserve the right to reject any offer to purchase by you at any time.

We will take all reasonable care, in so far as it is within our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the website.

When receiving a refund on a returned item the refund will be given on the purchase less the delivery charge.

Delivery

Jolaby Ltd (Atom Label) is responsible for your goods until they are signed for at the delivery address. In the event your goods are delayed in the delivery process longer than 48 hours a full investigation will be carried out by Jolaby Ltd (Atom Label). Refunds and exchanges will not be processed until the full investigation has been carried out. On rare occasions goods may be held in transit refunds will not be processed until goods are located and returned to Jolaby Ltd (Atom Label).

It is the customer's responsibility to ensure that the contents of any delivery are in accordance with delivery note within 48 hours of receipt of goods and, if no delivery note is present, it is the customer's responsibility to check the order against the order confirmation received at point of ordering alternatively contact Jolaby Ltd (Atom Label) immediately to ensure that all items comprising a delivery are present. Once signed for, no claims for failure to deliver may be levied against Jolaby Ltd (Atom Label.)

In the event a re-delivery is unsuccessful the goods will be returned to Jolaby Ltd (Atom Label) and a repeat delivery charge will be required in order to re-despatch your order.
 
Should you request the despatch of goods via your own arranged delivery service. The responsibility of the goods is no longer Jolaby Ltd (Atom Label) once goods are collected.
 
In the event goods are lost in transit or not delivered in the required time frame we will not offer any compensation.

INTERNATIONAL CUSTOMS & IMPORTS 

We ship all orders outside of the UK & Europe DDU (Delivery Duty Unpaid) and we do not collect VAT (Value added Tax.)

Customers outside of the UK will be liable for any customs/import duty, quotas, permits, products restrictions and other local requirements. These charges must be paid by the recipient of the parcel. Customs policies vary widely from country to country, therefore you are advised to check the latest applicable local requirements in your country before placing an order. In the event these costs as detailed above are not paid and this results in the goods being returned to Jolaby Ltd (Atom Label) these costs will be deducted from any refunds to be processed.

We welcome international orders, please be advised we are unable to ship/deliver to an address which is different to the cardholders address.

If returning an item from a non EU country please ensure you clearly mark your package *RETURNS* or Jolaby Ltd (Atom Label) may be charged duty/tax into the UK. In the event that this should happen the cost of duty/tax paid by Jolaby Ltd (Atom Label) would be deducted from your refund. Jolaby Ltd (Atom Label) may also refuse to accept the item.

RETURNS & EXCHANGES (B2C Business to consumer)

In the event of a refund you will be refunded the cost of your unwanted item(s) excluding outbound and inbound delivery costs.

Clothing must be returned with all swing tickets & security labels attached in an un-worn condition. Returns will not be accepted if there is signs of wear, washing, make-up, odour, deodorant, perfume or tanning products. Therefore please take care when trying items on.

Jolaby Ltd (Atom Label) is not responsible for any items that are returned to us by mistake. Jolaby Ltd (Atom Label) aims to accept all returns, in the unlikely event that an item(s) is returned to us in an unsuitable condition, the goods will be returned to you immediately.

Goods cannot be returned to Jolaby Ltd (Atom Label) without an authorised returns reference number, goods will not be signed for/accepted and will be returned to sender at cost of the customer. See returns centre for more information.

Strict attention must be given to the care labels on the garments and failure to comply with the recommended care instructions will not constitute a valid reason for returns.

RETURNS & EXCHANGES (B2B Business to business)


In the event of a return you must notify Jolaby Ltd (Atom Label) in writing within 2 days of receipt of your order, and the goods must be returned to Jolaby Ltd (Atom label) within 7 days of receipt. We advise you obtain proof of sending. Any returns outside of this period will be refused or will be subject to a re-stocking fee at the discretion of Jolaby Ltd (Atom label) The re-stocking fee is 15%, which may change from time to time. Contact Jolaby Ltd (Atom Label) to determine the exact amount. If the goods are specially ordered by the Buyer, and cannot be returned to the manufacturer, Jolaby Ltd (Atom Label) shall have no obligation to accept the return of the goods, and Buyer shall remain liable for the entire purchase price of the goods.

Clothing must be returned with all swing tickets & security labels attached with no additional labels attached nor original labels defaced. Garments must be in an un-worn condition. Returns will not be accepted if there is signs of damage, wear, washing, make-up, odour, deodorant, perfume or tanning products.

AVAILABILITY

All products on this website are subject to availability. In the event a product is not available you will be contacted as soon as possible.

DELAYS

Occasionally delivery of your order may be delayed or postponed on the rare occasion this may happen we will make every effort to keep you as informed as possible and discuss revised delivery time-scales with you.

PRODUCT CARE

Jolaby Ltd (Atom Label) strongly advise that all product care guidance is followed, returns will not be accepted for products that have been mistreated or product care guidance has not been followed.

FAULTY PRODUCTS

Please follow the returns process above for all faulty products. Please click here for the returns process.

If you believe your item to be faulty after purchase it has to be returned to Jolaby Ltd (Atom Label) to establish the fault. On all Jolaby Ltd (Atom Label) own brand products this may take up to 14 days to resolve. Guest brand products please allow up to 28 days.

Please be advised on repeat orders or orders placed with styles from two different production batches the colour tone of fabrics may vary slightly this is due to different dye batches of fabric and being manufactured at a different point in time. This is not deemed as faulty.

Should we make a human error and an incorrect item is despatched all return costs will be reimbursed. We would not offer any compensation.  

COMPLAINTS

Jolaby Ltd (Atom Label) always aim to provide the highest level of customer service. If you feel we have not met that aim, please contact us. We will respond to your complaint as soon as possible but always within 5 working days. Your complaint will be dealt with as fairly and as quickly as possible. If the complaint can not be resolved immediately you will receive weekly updates on the progress.

MARKETING COMMUNICATIONS

By signing up to our newsletter you are accepting to receive email marketing communication from Jolaby Ltd (Atom Label). Marketing communication will be carried out from time to time to notify customers on new stock and promotions. You can opt out at any time by accessing your account.

We reserve the right to change our terms & conditions from time to time

GENERAL

Jolaby Ltd (Atom Label) reserve the right at their sole discretion to update, change or replace and any of our terms and conditions by posting updates and changes to our website. Please periodically read our terms and conditions for any changes or updates made. Your continued use of or access to our website or the service following the posting of any changes to these terms and conditions constitutes acceptance of these changes.

We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on this site. You agree that it is your responsibility to monitor changes to our site and to read our terms and conditions.

In addition to the terms and conditions above the below applies to wholesale customers only.

WHOLESALE PRE-ORDER & MADE TO ORDER

If the order is cancelled or reduced later than 2 days after the date of order, then the customer will be liable to pay to Jolaby Ltd (Atom Label) damages amounting to 50% of the order value or of the value of the cancelled items. The customer accepts that this is a genuine pre-estimate of the loss or damage Jolaby Ltd (Atom Label) is likely to suffer.

If payment is not taken at point of order Jolaby Ltd (Atom Label) will issue an invoice for immediate payment, if payment is not received the order will be cancelled and a cancellation invoice will be issued.

WHOLESALE RETURNS

Any notifications of discrepancies or faults must be made known to Jolaby via phone within 48 hours of the receipt of a delivery and in writing by the customer to Jolaby Ltd (Atom Label) within 7 days of the date of delivery.

If a genuine fault with any items is established, Jolaby Ltd (Atom Label) will replace the item, or if a replacement is not available, issue a credit note. A credit note will also be issued in respect of the costs reasonably incurred by the customer in returning genuinely faulty items to Jolaby Ltd (Atom Label).

WARRANTIES & LIABILITY

Jolaby Ltd (Atom Label) warrants that the goods supplied will at the time of delivery correspond to the description given by Jolaby Ltd (Atom Label).

All other warranties, conditions or terms relating to fitness for purpose, quality or condition as to goods whether express or implied by statute or common law are excluded to the fullest extent permitted by law.

WHOLESALE FAQ’s

Will you supply to anyone else in my area?

If you have a physical store you can apply directly to Jolaby Ltd (Atom Label) to secure your immediate area (5 miles) from other stores. You must submit your request to secure your area in writing and it will not be automatically actioned after placing an order.

To be eligible a total spend of £2,000 exc. VAT must be ordered within a given season prior to the application being considered.
Please note you are at risk of another store stocking our brand in your immediate area until you have applied.

In any circumstance we reserve the right to remove exclusivity in your area without prior notice.

How long will you hold my area?

We will hold your area until 1st February for any orders placed in the Autumn Winter season and will will hold your area until 1st August for any orders placed in the Spring Summer season.

Can I make changes to my pre-order (forward) order?

Yes, within 2 days of placing your order. But unfortunately a 50% cancellation fee must be paid on any cancelled styles after this time as production would have already commenced.

Can I cancel my pre-order (forward) order?

Yes, cancellations must be received within 2 days from date of the original order being placed. If you cancel outside of the 2 day period a 50% cancellation fee must be paid.

If I repeat an order on a style will the colour match perfectly?

No, the colour tone of fabrics may vary slightly this is due to different dye batches of fabric and being manufactured at a different point in time. This is not deemed as faulty. This may be apparent when hanging in store alongside items from previous orders.
